Resolution authorizing summary publication of Ordinance 52.07 (Variance)

Recitals:

Whereas, on Nov. 17, 2011, the City Council for the City of St. Joseph amended Ordinance 52.07 Subd. 2 (a), entitled “Variance”; and

Whereas, the City of St. Joseph desires to publish the Ordinance by Summary Publication; and

Whereas, the proposed amended grants in addition to approving a variance prescribing appropriate conditions in conformity, recommending any adjustment or variance designating such conditions that secure the objectives of the regulation to which the adjustment is granted in regards to health and safety.

Whereas, the proposed amended requires a variance shall not be granted except when certain facts are found as stated in Ordinance 52.07, subd. 2 (a) 1 – 6.

Therefore, it is hereby resolved:
1. The City Council has reviewed the proposed Summary Publication and finds the summary of the Ordinance clearly informs the public of the intent and effect of the Ordinance.

2. The City of St. Joseph directs the City Administrator to publish the Ordinance by Summary Publication.

Adopted this 17th day of Nov., 2011, by a vote of 5 in favor and 0 opposed.
